CREDIT LINES FOR EDITORIAL USE
The credit line "Photo courtesy of NC Division of Tourism, Film and Sports Development" must appear adjacent to the Image(s) unless otherwise noted.
DEFINITIONS
Images(s) shall mean animations, clipart, composites, digital footage, digital video, film footage, fonts, graphics, illustrations, images, motion sequences, photographs or any other visual representation.
User shall mean the individual, legal entity or agent entering into this agreement or any employee or contractor of such individual or legal entity. All Users shall only use the Images in accordance with the terms of this agreement.
Users represent and warrant that they are at least eighteen years of age and have the full right and authority to enter into this agreement on behalf of you/your company, employer or principal.
COPYRIGHT
All Images contained herein are the property of, and will remain the property of, the North Carolina Division of Tourism, Film & Sports Development. Use of the Images is permitted, not sold.
The Image(s) are copyrighted and protected under the various laws of the United States, International treaties and other applicable laws. Use of the Images without agreeing to these Terms & Conditions is a copyright infringement.
PERMITTED USES
Image(s) may be used in electronic or print media provided such use is not intended to allow the re-distribution or re-use of the Image(s). Images are not for advertising or commercial use.
PROHIBITED USES
Users may not:
- Sublicense, distribute, transfer or assign the Image(s) or the rights to the Image(s).
- Use the Image(s) in a product or service, or for commercial use, or advertising of a product or service.
- Use the Images in any way that could be considered defamatory, pornographic, libelous, immoral, obscene or fraudulent, or illegal, either by making physical changes to it, in the juxtaposition to accompanying text or images, or otherwise.
LIMITATION OF LIABILITY
Image(s) are provided "as is" without warranty of any kind, either express or implied.
There shall be no liability for claims related to or arising from any User alterations, modifications or combinations made to Image(s).
MISCELLANEOUS
The North Carolina Division of Tourism, Film and Sports Development reserves the right to not permit use of any Image(s) for any reason whatsoever and notify you that certain images are no longer available for use. Upon such notification, use of such Image(s) shall automatically and immediately terminate.
The North Carolina Division of Tourism, Film and Sports Development reserves the right to replace Image(s) with an alternative Image for any reason.
Acceptance of these terms and conditions forms a legal contract between you and the North Carolina Division of Tourism, Film and Sports Development. This agreement is effective until it is terminated.
